WIPO (World Intellectual Property Organisation) Trade Mark Application
A WIPO International Trade Mark Application allows an existing trade mark owner to file in multiple other countries under what is known as the Madrid Protocol. Please note that you require an existing United Kingdom or Guernsey trade mark in order to be able to make a Madrid Protocol application through IP Lab. In addition, you will also have to be eligible to make such an application under the Rules of Entitlement set down by WIPO. The Madrid System is a convenient and cost-effective solution for registering and managing trademarks worldwide. In involves the filing of a single application and the payment of one set of fees to apply for protection in up to 123 countries. Each International Trade Mark can then be modified, renewed or expanded as required through one centralised system.
Countries
We are able to apply for an International Trade Mark system for any number of member countries, utilising the base trade mark in either Guernsey or the United Kingdom. For a full list of member countries, please see here.
Procedure
Please let us know the trade mark you will be using which will form the base mark for your International Trade Mark Application. This can be either a pending application or a registered mark. Your can only apply for the same or less goods and services as those covered by the existing mark. Please also choose the number of countries to be designated under the application and add these to the order. Please note that our fees do not cover the fees payable directly to WIPO under such application. We generally ask that clients transfer funds directly to WIPO, in order to minimise problems with bank charges, exchange differences and other banking related issues which can cause delays. Once we receive the order from you, we will confirm the countries you require and then prepare and submit the forms to the appropriate registry, either in Guernsey or in the United Kingdom. Once received by them, the appropriate registry will then check the application and then transmit this to WIPO for processing.
